Audience:
Karen Turk, 335 Sixth Avenue, sent an e-mail to all of council concerning Ervin Terrace between Fifth & Sixth Avenue. Ms. Turk thinks making this into a two-way street will create more problems.

ORDINANCE NO. 2017-#4
AN ORDINANCE AMENDING THE CITY TRAFFIC SCHEDULES TO MAKE ERVIN TERRACE A TWO-WAY STREET BETWEEN FIFTH STREET AND SIXTH AVENUE.
This ordinance makes Ervin Terrace a two-way street between Fifth Street and Sixth Avenue amends the City of Dayton Traffic Schedule by removing Ervin Terrace from the list of streets designated one-way in the City of Dayton Traffic Schedule.

ORDINANCE NO. 2017-#5
AN ORDINANCE AMENDING CHAPTER 154 OF THE DAYTON CODE OF ORDINANCES COMMONLY REFERRED TO AS THE CITY OF DAYTON ZONING ORDINANCE BY AMENDING THE TEXT TO ALLOW FOR TATTOO AND BODY PIERCING ESTABLISHMENTS IN CENTRAL BUSINESS DISTRICT AND REGULATE SUCH ESTABLISHMENTS.
This ordinance amends Chapter 154 of the City of Dayton Code of Ordinance (Zoning Ordinance) by allowing for Tattoo and Body Piercing Establishments in the Central Business District. The ordinance further regulates Tattoo and Body Piercing Establishments by requiring a permit from the Health Department and compliance with all Kentucky Administrative Regulations to include regulations that govern construction, operation, and sanitation practices of Tattoo and Body Piercing Establishments.

ORDINANCE NO. 2017-#6
AN ORDINANCE AMENDING CHAPTER 154 OF THE DAYTON CODE OF ORDINANCES COMMONLY REFERRED TO AS THE CITY OF DAYTON ZONING ORDINANCE BY UPDATING THE CHAPTER AND NUMBERING SYSTEM THAT WILL BE EASIER TO USE AND MORE COMPATIBLE WITH ONLINE USE.
This ordinance amends Chapter 154 of the City of Dayton Code of Ordinance with an updated numbering system that will be more user friendly and compatible with online use.

CITY ADMINISTRATOR’S REPORT:
KZF was hired for the design of Riverfront Commons. The budget has been approved by the State. Since we did not originally add this into the city budget, I’m asking for approval to pay the bill when received. In the Economic Development Fund, under capital outlay, $200,000 has been approved. The cost is $90,167.00 for the design work. Once paid the bill will be submitted to the State and the city will be reimbursed at 100%. Motion by Member Lynn, seconded by Member Haas to pay $90,167.00 out of Economic Development Fund.

Comments:
Member Neary asked when the planning meeting would be held to go over the design. City Adm. Giffen reported a meeting was held in February. Invited were two council members, main stakeholders, developers, and public service entities. Member Neary would like more public in-put before we get too far along in the design. People invited to the meeting were directly involved with the design. Only so many people could be invited.
CITY ATTORNEY’S REPORT:
City Attorney Edge noted the city received a favorable verdict in the lawsuit submitted by a former employee.
DEPARTMENT HEAD’S REPORT:
Bob Yoder, Main Street Manager, thanked everyone who attended the ribbon cutting for Home Town Heroes. The Main Street Advisory Board met on the 28th and held a public meeting to discuss applying for a grant to open the trails at Sargeant Park. Everyone was very positive. On the 31st the paperwork was submitted to the State. It will take six to nine months to hear back from the State. Trotta’s Steak/Seafood will be opening at 441 Sixth Avenue by the end of this month or early May.
Donna Leger, Clerk/Treas., submitted a copy of the monthly financials. Please submit your Code of Ordinances book to the Clerk’s Office for an update.
Rich McAllister, Director of Codes, reported the ordinances and code board are in place. Rich will start citing for grass and paint.
Michael Auteri, Fire Chief, submitted a copy of his report. The Firefighters are getting their annual physicals this month. On April 29, the American Red Cross and our firefighters will be installing more than 1000 free smoke detectors in Dayton & Bellevue. The fire department paramedics are seeing a severe spike in the number of overdose runs so far this year. The new Ladder Truck Committee visited Rosenbauer on March 30, 2017 for a final inspection of the truck. It is anticipated the new truck will be leaving the plant in the next 14 days. The 2017 Board Meeting dates are: April 19, 2017, June 21, 2017, August 16, 2017, October 18, 2017, and December 20, 2017.
David Halfhill, Police Chief, submitted a copy of his report and thanked Rich McAllister, Director of Codes, and the Fire Department for their help with nuisance properties. Three properties have been dealt with and people have been evicted.
UNFINISHED BUSINESS:
The Planning & Zoning Board will meet the first Wednesday in May to discuss zoning in the Neighborhood Business District. If changes are made the first reading should be in June.
The park on Walnut Street will be moved to Vine Street. The closing on the second piece of land should be tomorrow. Work on the park should start next week.
The cost of the sidewalks on Sixth Avenue/Bump outs and Dayton Pike Sidewalk came in higher than expected. We had to move funds around and get approval at the State Level. The process is very slow at the State Level. GRW is still hired to do the work.
